First and second degree
In Canada, murder is classified as either first or second degree.[31]

First degree murder is a murder which is (1) planned and deliberate, (2) contracted, (3) committed against an identified peace officer, (4) while committing or attempting to commit one of the following offences (hijacking an aircraft, sexual assault, sexual assault with a weapon, aggravated sexual assault, kidnapping and forcible confinement or hostage taking), (5) while committing criminal harassment, (6) committed during terrorist activity, (7) while using explosives in association with a criminal organization, or (8) while committing intimidation. Second degree murder is all murder which is not first degree murder.

and this is 2nd degree murder. Does 2nd degree murder mean the same thing in Canada as it does in the US? Or is it more of an insanity thing?

If this actually stays as a 2nd degree murder (as we use it in the US), Canada's legal system is a joke.


I think that in some jurisdictions in the U.S., first-degree murder is reserved for cop-killings. Because, you know, they're the most important people in our society, and killing anyone else is automatically not as serious.

This is pretty much the meat of the law in the states. He didn't know the guy, had no plans to kill him in particular, and probably only vaguely planned to hurt someone.

Same shit happened here in Seattle this year. Homeless fuck kills a woman on her Capital Hill front door stoop, at about 10 pm, and he got 2nd degree charges because he wasn't nutty enough to plea insanity and he didn't plan to kill that woman...

...I should check my local paper real quick to see if I can find linkage.

He didn't plan to kill that guy. That's how I understand the law. To get first degree you have to have a motive and a target.

Other strange circumstances can call for 1st degree. Sexual assault, grizzly hatchet murders, etc. So this might eventually fall under 1st.
