through the Services does not violate the privacy
rights, publicity rights, copyrights, contract rights
or any other rights of any person. You agree to pay
for all royalties, fees, and any other monies owing
any person by reason of any Content posted by you to

2. The Services contain Content of MySpace.com
("MySpace.com Content"). MySpace.com Content is
protected by copyright, trademark, patent, trade
secret and other laws, and MySpace.com owns and
retains all rights in the MySpace.com Content and the
Services. MySpace.com hereby grants you a limited,
revocable, nonsublicensable license to reproduce and
display the MySpace.com Content (excluding any
software code) solely for your personal use in
connection with viewing the Website and using the
Services.
3. The Services contain Content of Users and other
MySpace.com licensors. Except for Content posted by
you, you may not copy, modify, translate, publish,
broadcast, transmit, distribute, perform, display, or
sell any Content appearing on or through the Services.

To my mind, it's a licensing agreement that protects MySpace from some nutball trying to sue them for royalties when some kid puts their song on his or her profile, that's all.

So many points can be made for why being alarmed about their terms of usage is a waste of time:

-How many bands have stuff on MySpace now? The chances of MySpace deciding to pick your tunes out of the sea of information available on the site are worse than your chaces of being killed by a terrorist in the next year.

-The compression involved in encoding an mp3 pretty much renders your audio files unusable for any kind of broadcast-quality ad, video game soundtrack, etc. (not to mention the shit recording quality of most MySpace artists' files to begin with.)

-The moment one single artist DID find evidence of MySpace using their music without their permission for something other than the website itself, word would spread so fast that most artists would yank their shit within a day's time, rendering the MySpace music community useless.
